The accommodation service is intermediated by HOTELOPIA S.L.U. (hereinafter referred to as "easyJetHotels"), a legally constituted Spanish company, which operates as a wholesale-retail travel agency. Hotelopia, S.L.U. is based in Palma de Mallorca 07006 (Spain), C/ Calle Padre Ventura 19, with licence number BAL-481 M/D, tax identification code B-57218356 and registered in the Mercantile Register of Mallorca (page PM-44857, volume 2007, folio 148). easyJetHotels is a registered trademark of easyJet Group and is licensed to Hotelopia, S.L.U. for the sale of accommodation through easyJet related websites as www.easyjethotels.com.

Therefore Hotelopia, S.L.U. is entitled to use easyJetHotels trademark for the sale of accommodation. The domain name www.easyjethotels.com is owned by easyJet Group.The following Terms and Conditions form the basis of your relationship with easyJetHotels. Please read them carefully as they set out our respective rights and obligations. The content of this website is directed solely at consumers who book the product through easyJetHotels (hereinafter referred as "you" or "your"). Access to the easyJetHotels website is strictly controlled by easyJetHotels and easyJetHotels reserve the right to change, modify, substitute or suspend or remove without notice any information or service from time to time.

References to "accommodation providers" means the owner/providers of the hotels, apartments, villas and other accommodation of any description featured on this website and "accommodation" means the accommodation including all facilities and services advertised on our website that we have agreed to arrange in connection with your confirmed booking.

easyJetHotels acts as agent only in respect of all bookings we make on your behalf. easyJetHotels accepts no liability in relation to any contract you enter into or for any accommodation that you book or for the acts or omissions of any accommodation or other person(s) or party(ies) connected with your booking. For all bookings your contract will be with the accommodation provider concerned. The accommodation provider's booking conditions will apply to your contract and prices and cancellation conditions shall be displayed when making each reservation, dependant on prevailing conditions, availability and other factors. The website will guide you through the procedure for making a booking.

Any booking that you make through this website is conditional on you accepting these General Terms and Conditions, the legal statement and privacy policy (the "Terms"). The Terms form an integral part of our website and cannot be separated from the general contracting conditions, operations or reservations. By visiting, using or ordering from the website easyJetHotels, you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern this website and your booking.

If you do not agree to be bound by the Terms, you must not proceed with your booking.

1. Modification of terms and conditions

easyJetHotels may make improvements or changes to the information, elements, data, services, and other materials on this website, or terminate this website, at any time without notice.

easyJetHotels may also modify the Terms at any time, and such modification shall be effective immediately upon posting of the modified Terms on this website. Accordingly, your continued use of or access to this website will be deemed to indicate your acceptance of the modified Terms.easyJetHotels may suspend access to website, due to maintenance works, net security reasons or force majeure causes (as defined in section 10.), with no obligation to reimburse or compensate to you for the period that access was suspended.

2. How to book your accommodation

Simply search for your chosen destination and dates, select your preferred accommodation provider and proceed to the final booking page. Details of your selection will be featured at the top of the page and also on the top right hand side. Please ensure you carefully check the dates, the price, the destination and the accommodation provider details before proceeding with your booking.

On the menu bar you will also see details of the cancellation fees that will be levied by the accommodation provider. If you agree with your selection, please continue to add your personal and payment details. Again please ensure you check all your details carefully before proceeding with your booking.

Any information entered into our payment page is securely encrypted during transit and the easyJetHotels site is verified by Thawte. For more details on this area, please refer to "Payment Details" below.

To confirm a booking, you must be authorised to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking, you are confirming that all persons named on the booking accept the Terms and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due to us.

Once easyJetHotels has received your booking and all appropriate payments, easyJetHotels will, subject to availability, confirm your booking on behalf of the accommodation concerned by issuing a confirmation e-mail containing an accommodation booking voucher which you should retain and print so it can be presented at the accommodation on arrival. Please check the accommodation booking voucher carefully as soon as you receive it and contact the easyJetHotels customer services immediately if any information which appears on the accommodation booking voucher or any other document appears to be incorrect or incomplete. As easyJetHotels act only as agent we will have no responsibility for any errors in any documentation except where those errors were made by easyJetHotels.

A binding contract between you and the accommodation provider comes into existence when we issue the confirmation e-mail containing the accommodation booking voucher on behalf of the accommodation. If you have been requested to return a Credit Card Data Authorisation the binding contract will not exist until easyJetHotels receive the Authorisation.

Access codes and reservation number provided by easyJetHotels are for your sole and personal use; no access code and reservation number can be transferred or disclosed to third parties and you shall be directly responsible for the use of your own access codes or personal number.

Improper use by you of any access code or personal number shall result in the access code or personal number being withdrawn, any transaction will immediately be terminated and legal action against you may be considered.

3. Age and responsibility

You warrant that you are 18 years of age or over and have legal capacity to use the easyJetHotels site and to create a legally binding contract.

You warrant that all personal information submitted during accommodation bookings, newsletter registration, and membership registration is correct and you accept financial responsibility for all transactions made under your name or account.

You hereby authorise easyJetHotels to ask for and to collect from the accommodation all personal information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed as the following and will include, but not be limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group that the accommodation may have access to.

The personal information that easyJetHotels collects from the accommodation shall be obtained, processed and transmitted in compliance with European Directives 95/46 and 2002/58, as well as any other such legislation that substitutes complements and develops it. 4. What´s included in your booking

The basic accommodation cost includes the following:

* Accommodation, meals and any other services as stated on your accommodation booking voucher.

* All obligatory accommodation establishment service charges and taxes: Excluding some USA resort fees who require an additional resort fee, on arrival at the accommodation establishment. Please refer to the Observations within your chosen "Hotel Info" page which will advise if any additional resort fee is required on arrival.

* VAT on all holidays in EC countries

5. What´s not included in your booking

The basic accommodation cost does not include:

* Transfers between airport and accommodation

* Excursions and other personal expenditure

* Additional charges for rooms, meals or under-occupancy in apartments that are not stated to be included in your booking

* Charges that accommodation establishments or apartments may make for facilities such as cots, parking, minibus services, sun beds, sauna, tennis courts and equipment, porters etc

* Deposits requested on arrival by some apartment/villa owners

* USA Resort Fees: Some USA resorts require an additional fee on arrival which easyJetHotels is unfortunately unable to include within our rates. The majority of all our products include fees, taxes etc - however if you have selected a USA Resort - Please refer to the Observations within your chosen "Hotel Info" page which will detail if any additional resort fee is required on arrival.

* In some countries there is a local tax known as "stay tax" or "tourist tax" (eco-tax) which must be paid directly at the accommodation and/or the airport. The Russian tourist tax must be paid directly by you at the first accommodation when arriving in the country.

Children

Child prices and other conditions relating to children are agreed upon with each accommodation provider and are not based on any one criteria; therefore, given that each accommodation provider applies its own special conditions and prices, we ask that you enquire about this point when making your booking.

Accommodation services: Any child prices or special conditions will only apply when children share a room with 2 paying adults.

COTS (UK) /CRIBS (US) - please advise us at the time of booking if you require a cot or crib. easyJetHotels will pass your request to the accommodation provider, however, we cannot guarantee this request will be met. Such request will be subject to availability and if the accommodation is unable to meet any such request, neither easyJetHotels, nor the accommodation, will have any liability to you in this respect. This request may only be available at an additional cost unless otherwise expressly stated in the description of the accommodation provider and if any additional cost is applicable this should be paid by you direct to the accommodation provider.

Extra Beds

Some accommodation providers have twin or double bedded rooms that will accommodate a third bed. Details on any supplement and/or discount applicable where a third bed is to be occupied by an adult can be obtained from the accommodation provider. Accommodation providers may have no, or limited numbers of, extra beds so the ability to provide a third bed will subject to availability.

Any request for an extra bed must be made at the time of booking and if the accommodation is unable to meet any such request, neither easyJetHotels, nor the accommodation, will have any liability to you in this respect

6. Payment details

At the time of your booking, the full quoted amount will be deducted from your credit or debit card. Payment transactions on the easyJetHotels website are encrypted by a secure payment system endorsed by some of the world's leading banks and our site is verified by Thawte.

This technically secure environment ensures that credit card details cannot be intercepted and are not revealed to anyone other than to financial institutions required to process payment instructions from the customer.

In some instances easyJetHotels shall send by email the Credit Card Data Authorisation and you shall return to easyJetHotels the Credit Card Data Authorisation by fax in order to confirm and conclude the booking process. Where this has been requested, the booking shall not be considered confirmed until easyJetHotels has received the Authorisation.

7. Booking modification or cancellation

You may modify or cancel your booking at any time prior to your arrival date on easyJetHotels´ website or call centre. Date and time to be considered for modifications and cancellation shall be the date/time at destination or hotel location.

You will be advised at the time of booking of the cancellation charge levied by the accommodation. During the booking stage you will see the cancellation fees that apply to your booking, quoted on the right hand menu. Charges payable may vary from the cost of one night to 100% of the amount of the booking.

Proceeding with your reservation means you expressly accept such charges. If you have any questions or are unclear about the charges that apply to your booking - please contact our Customer Services.

Modifications

Modifications involving a partial cancellation, amendment or reduction in number of nights within the timescale that cancellation fees apply, may also be subject to cancellation expenses.

Modifications to extend the reserved period shall be subject to availability and any increase in price will be charged and become payable immediately.

Once a booking has been modified, modifying it again might cause an increase to the price, even if this change is to restore the original booking dates, occupancy and/or conditions.

Cancellations

If you cancel your booking prior to your arrival date, you may be charged a cancellation charge. easyJetHotels will refund to you the amount paid under the contract minus any cancellation charges incurred by the accommodation provider.

You should cancel your booking through the easyJetHotels website and the website will advise you of cancellation charges. Cancellation charges will vary according to the accommodation provider, the destination and the dates selected.

If for exceptional reasons the cancellation cannot be made via the easyJetHotels website or call centre, your letter of cancellation must be sent in writing or by email to easyJetHotels detailing the destination and reservation number. easyJetHotels shall send acknowledgement of receipt and inform of all the charges, if any, which may be applicable. You shall be responsible for obtaining the confirmation and/or acknowledgement of receipt of the cancellation of the reservation by easyJetHotels.

If you decide to leave the accommodation before the due departure date you should address any claim for a refund of any unused nights to easyJetHotels within twenty days of your arrival date, together with written confirmation from the accommodation provider of time and date of your departure. easyJetHotels may be able to negotiate with the accommodation provider for a refund of any unused portion of the accommodation, however, this is at the absolute discretion of the accommodation provider and easyJetHotels. In particular, during peak occupation periods the accommodation provider may charge the full amount of the original reservation, in which case you shall not receive any refund.

Reservations made via easyJetHotels may be cancelled by either party with no penalty whatsoever in the event of force majeure, such as, without restriction, war, revolution, acts of terrorism, closure of borders, epidemics, catastrophes which may affect the various destinations and, specifically, the location of the accommodation provider.

In the event that Hotelopia, at its own discretion, considers that a booking has been made fraudulently, the booking shall be cancelled and the transaction value will be returned to the same Credit / Debit card used for the transaction.

Failure to honour the booking (No Show)

If, for whatsoever reason, you do not turn up at the accommodation on the arrival date stated on your accommodation booking voucher without prior warning to easyJetHotels this shall be considered a "no show". In the event of a no show without prior warning you will not be entitled to any refund.

Important

Throughout the year, some accommodation providers may change name or trading name, which shall not be construed as a change of accommodation or modification/amendment of the reservation.

Any accommodation ratings and/or categories have been provided by the accommodation providers and are in accordance with local regulations applicable to each country. Therefore Accommodation in one country may not be similar in terms of services and quality to accommodation in another, despite stating it is of the same category or rating.

easyJetHotels will advise you of any information supplied by the accommodation provider regarding the existence and duration of any refurbishment or renovation works within the accommodation. Since easyJetHotels is merely acting as agent in passing on information supplied by the accommodation provider, easyJetHotels will not accept any claim from you regarding refurbishment or renovation work of which easyJetHotels has not been advised or which extend beyond the planned date of conclusion.

easyJet flights are provided by different company, therefore easyJetHotels is not responsible for the cancellation, delays of the flights or any circumstances regarding flights booking Terms and Conditions; and how it might affect the accommodation reservation.

Changes to and cancellation of your booking by the accommodation provider

If there is a change to or cancellation of your booking easyJetHotels will pass on the new details to you together with any compensation that the accommodation provider may offer. As agent only for the accommodation provider easyJetHotels cannot accept any liability for any changes or cancellations made to your booking.

8. Before you travel

easyJetHotels is not liable for damages or losses that may result from travel to any particular destination. Your National Government's Foreign Office helps travellers stay safe overseas. Check your National Government's Foreign Office website for the latest advice on conditions and general information concerning specific countries.

It is your responsibility to ensure you have the relevant travel and health documents before departure for the country you are visiting, which shall include, but is not limited to, any inoculations that may be required, ID’s, passport, and possibly also marriage certificate for couples sharing the same room in some Muslim countries.

9. Insurance

You are strongly advised to take out adequate travel insurance prior to arriving in your destination. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return home in the event of an accident or illness.

10. Force majeure

easyJetHotels will not be liable for any changes, cancellation, effect on your booking, loss or damage suffered by you or for any failure by the accommodation providers and/or easyJetHotels to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non performance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and in particular the place where the accommodation provider is located as well as the country of origin of easyJetHotels and other unforeseeable causes beyond easyJetHotels´ control.

11. Complaints or issues with your accommodation

In the unlikely event that you have reason to complain or experience any problems with your accommodation please inform the accommodation reception staff or management immediately, to enable them to take appropriate action.

Should you not be satisfied with the offered solutions, please contact easyJetHotels Customer Services, whilst you are at the accommodation, and we will offer all reasonable assistance to try and rectify the situation to your satisfaction.

easyJetHotels acts only as agent for the accommodation provider and therefore cannot accept any liability for any loss or damages caused by the acts, omissions or negligence of any of the accommodation provider. Your contract for the accommodation is directly with the accommodation provider concerned.

However, in the event that easyJetHotels is found liable on any basis whatsoever in relation to your booking our maximum liability to you if easyJetHotels is found to have been at fault in relation to any service that easyJetHotels provide as agent for the accommodation provider concerned (as opposed to any service provided by the accommodation provider for whom easyJetHotels is not responsible) is limited to the cost of the booking in question.

easyJetHotels do not exclude or limit liability for death or personal injury that arises as a result of the negligent act or omission of easyJetHotels or its employees whilst acting in the course of their employment.

12. Indemnification

easyJetHotels acts as an independent intermediary in the contracting of accommodation and other services, and shall thus not be held liable for death, injury, illness, damage, loss, accident, theft, delays or any other irregularity which may arise, whether directly or indirectly, from the supply of services by the accommodation provider or other suppliers and which have been contracted via this system. Also, easyJetHotels shall not be liable for any indirect, special or consequential loss, including economic loss, which term shall include loss of profits, loss of use of profits, business, revenue, and goodwill or anticipated savings.

easyJetHotels shall use reasonable endeavours to make the accommodation provider deal with any complaint you may raise.

easyJetHotels shall not be able to negotiate any claim with the accommodation provider that is raised after date of your departure from the accommodation in question.

You will at all times save harmless and keep fully indemnified easyJetHotels from and against any actions, claims, proceedings, losses, costs, expenses and demands (including costs and expenses in defending such matter and its proper compromise) arising directly or indirectly out of or incidental to or in connection with any breach by you or by any of the people you booked on behalf of, of any of the provisions of these Terms or contravention of any laws or rights of a third party, or your use of this website.

When you book accommodation through easyJetHotels, you accept responsibility for the proper conduct of yourself and the other people on your booking during your stay. easyJetHotels and/or the accommodation provider reserves the right at any time to terminate your stay and that of any member of your party due to your or their misconduct, where justified in the reasonable opinion of easyJetHotels and/or the accommodation provider. Full cancellation charges will apply and no refund will be given. Furthermore, neither the accommodation provider nor easyJetHotels shall be under any obligation whatsoever to pay compensation or meet any costs or expenses you may incur as a result of your stay being terminated. If your actions or those of any member of your party cause damage to the accommodation in which you are staying, you must fully reimburse the accommodation provider for the cost of the damage before you end your stay. You also agree to indemnify easyJetHotels against any claim (including legal costs) made against us as a result.

Notwithstanding the above easyJetHotels entire liability, whether in contract, tort (including breach of statutory duty), or otherwise shall not exceed the sums paid by you to easyJetHotels for the specific services in question.

13. General

These Terms and Conditions contain some exclusions and limitations of liability. If any part of the conditions proves to be not valid or unenforceable, the rest of the conditions will remain valid. The invalid or unenforceable condition will be deemed as supplanted by an enforceable and valid form conveying the same meaning. Any dispute will be governed by the law and jurisdiction of the Spanish courts.

You agree that your use of this website does not imply that any partnership, joint venture, employment or agency relationship exists between you and easyJetHotels.

15. Lowest Rate Guarantee

Most of our hotels are offered at hugely discounted rates. We're so committed to bringing you the lowest prices that if you find the hotel you have booked at a lower price for the same dates on any other site, easyJetHotels will refund the difference and reward you with a £10/15€ discount voucher for your next stay.

To qualify for our Lowest Price Guarantee - please follow the steps below:

Book your chosen accommodation establishment with easyJetHotels and pay for it.

If within 24 hours you find the same room type and board type in the same accommodation establishment for the same dates - at a lower price, please enter the following information within the "Contact us" page:

Name of accommodation establishment

Name of other website and price quoted

A contact email address

Your postal address

Valid claims: valid claims must be made within 24 hours of booking on easyJetHotels and Lowest Rate Guarantee does not apply to Senior Citizen Discounted Rates or any group discounts or special offers.

In the event the same room type in the same accommodation establishment for the same date, occupancy and board type, is found at a lower price on another website, easyJetHotels will refund (on valid claims) the difference between the advertised rate on easyJetHotels and the other available rate, and reward you with a £10/15€ discount voucher subject to the following conditions:

a) Claims for any refund must be made within 24 hours of booking on easyJetHotels.

b) On-request rooms are excluded from this price promise and rooms must be available for immediate retail consumer bookings online.

c) easyJetHotels will confirm valid claims within 5 working days of receipt.

d) Claims for refunds must be based on a comparison of the same accommodation establishment for the same dates, and same room type and occupancy. The rate must be inclusive of the same services as those offered by easyJetHotels (for example service charges, taxes and breakfast etc.).

e) easyJetHotels must be able to verify the alternative rate is both available and bookable online.

f) The Lowest Price Guarantee will cover bookings made for up to 4 customers and a maximum of 7 nights´ stay.

g) Refunds and £10/15€ discount voucher forwarding will only be made after completion of stay by the claimant at the named accommodation establishment for the named booking and will be credited within 180 days after completion.

h) Money refunds and £10/15€ discount voucher might not be credited/forwarded together.

i) The maximum amount refunded shall not exceed the total value of the booking made.

j) easyJetHotels must be able to verify the alternative rate is both available and bookable online

k) The claimer must be the credit cardholder. Shall only be accepted one claim per 3 months, per family and cardholder.

l) easyJetHotels will not reimburse customers if:

Rates are compared with a package

Rates are shown in a currency different to that quoted by easyJetHotels

The competitor rate is not offered by a UK bonded travel agency and/or if the rate is offered on a branded accommodation establishment chain website

The best rated accommodation is not located where easyJet Airline currently operates

m) Reimbursement of the difference will be made in the same currency and payment method as the original booking made on easyJetHotels.

16. WARNING - USA restrictions on travel to Cuba

Travel to Cuba by citizens and a resident of the United States is subject to the laws of the United States pertaining to the U.S. embargo of Cuba and requires a license by the United States Government. No refunds will be made or liability incurred with respect to any travel arrangements made by citizens or residents of the United States without required licenses.

17. USA Resort Fees

Although all our rates include taxes and service fees in the vast majority of cases, some USA resorts require travellers to pay for an additional Resort fee on arrival to the resort. We would like to include these rates within our quoted prices however these fees are issued on arrival. Please refer to the Hotel Info page under Observations to see if there is an additional rate applied to your selection, only if you are booking a accommodation establishment in a USA Resort. Within our search results we clearly state that there may be an additional fee.

Please note that the easyJetHotels Call Centre and Customer Service Team cannot deal with any enquiries or issues with regards to any of these third party products and services. Such enquiries or issues can be dealt with by contacting the customer service departments on the corresponding partner sites (customer service contact details are provided individually on each site).

19.Assignment of Rights

easyJetHotels reserves its rights to assign in total or in part the obligation or rights of these Terms to any subsidiary, affiliate or holding company or any subsidiary of its holding company.

You are not allowed to assign any obligation or right of these Terms, or any other agreement which completes them to any third party, unless prior express authorisation by easyJetHotels.

20.Legislation and Courts of Jurisdiction

The application and interpretation of these Terms and Conditions shall be governed by current and applicable Spanish Legislation. In the event of any discrepancy which may arise from interpretation or the execution of these terms and conditions, the parties, with express waiver of any other court of jurisdiction which might apply, if any, shall abide by the Jurisdiction and Competence of the Courts of Palma de Mallorca, Spain.
